Access and user status

Access to and use of the website www.ercros.es confers the status of user on those who access and use it. The user, by the mere fact of being a user, expresses full and unreserved acceptance of each and every one of these general conditions, as well as the specific conditions which, where appropriate, complement, modify or replace the general conditions in relation to certain services and contents of the website.

When it is necessary for the user to provide personal data in order to access any of the specific services, the provisions of the section on personal data protection shall apply to the collection and processing of users' personal data.

The user has no right to claim compensation of any kind (direct or indirect) for temporary interruptions or definitive suspension of the services, either for his own or other causes.

The user undertakes, being solely responsible, to use the website and the services and contents offered by Ercros in accordance with the law, these general conditions and any updates thereto in accordance with the generally accepted rules of good faith, morality and public order.

The main service offered in the www.ercros.es domain is the provision of information on Ercros' business and products, as well as news and information on the stock market and the economy, and on the company's social responsibility.

Provision of services by Ercros

The provision of Ercros services through www.ercros.es is free of charge, of indefinite duration and freely revocable without affecting the rest of the general conditions.
Ercros, S.A. shall notify the user, whenever foreseeable, of any interruption in the service that may occur due to the updating or improvement of the services, maintenance of the same or for other causes.

Unilateral modification

Ercros may, whenever it deems appropriate and without prior notice, update, modify, suspend or eliminate, temporarily or permanently, the presentation, contents and services of the website, as well as modify and update, totally or partially, the structure and design of the website.

Likewise, Ercros reserves the right to modify or update these general conditions at any time, which shall be published on www.ercros.es, without the need for any additional notification to users of the website.

The date of the last update of the contents on www.ercros.es may be requested by the user by sending an e-mail to ercros@ercros.es.

Accessibility

Ercros' intention is that everyone, regardless of their disability, condition or the technology used, should be able to access and browse its website without difficulty. To this end, Ercros has taken the following measures in the development of its website:

• Programming of the site in compliance with the recommendation on cascading style sheets, level 2, of the W3C.
• Logical order of presentation of the elements on the screen.
• Alternative text in the images.

Intellectual and industrial property

All the contents of the website www.ercros.es in the form of texts, source code, computer codes, graphic design, animations and images, as well as registered trademarks, trade names, distinctive signs and other designations are the property of Ercros, unless it is indicated therein that they belong to another owner, and are subject to the intellectual and industrial property rights of Ercros, S.A. or third parties and are protected by law.

Under no circumstances does access to Ercros services imply the waiver, transmission, transfer or total or partial licence of said contents to third parties, nor does it confer any right to use, translate, alter, adapt, exploit, copy, distribute or publicly communicate said contents without the prior express authorisation of Ercros, S.A. or of the third party holder of the rights affected. Under no circumstances is the commercialisation of the contents accessed at www.ercros.es or the use of the same in contravention of current legislation on industrial or intellectual property and in any way that damages the image of the company authorised (and will be prosecuted).

The legitimacy of the intellectual or industrial property rights corresponding to the contents provided by third parties is the exclusive responsibility of the latter.

Ercros may exercise all the administrative, civil or criminal actions to which it is entitled in the event of infringement of these rights by the user.

Exclusion of warranties and liabilities

Ercros, S.A. accepts no liability for any misuse of the contents.

The use of the www.ercros.es website shall be carried out under the sole and exclusive responsibility of the user.

The user undertakes to make appropriate use of the contents and services offered by Ercros through its website and related participation sites, and undertakes not to use them to cause damage to the physical or logical systems of Ercros, its suppliers or third parties, introduce or disseminate computer viruses or any other physical or logical system that may cause the aforementioned damage.

Ercros shall not guarantee nor shall it be liable for damages of any kind that may arise from telephone interference or breakdowns, disconnections in the electrical system, computer viruses, malware or any other factor beyond its control. Nor shall it be responsible for the contents or systems of third parties connected to the Ercros domain.

Ercros shall not be held responsible for the accuracy, veracity and validity of information that is not of its own creation and whose contents belong to third-party information sources outside its control. Ercros shall only be liable for its own services and content directly originated by it.

Ercros reserves the right to take appropriate legal action against those who violate these conditions.

Ercros shall not be liable for the opinions expressed by users through forums, Facebook, Twitter or other participation tools.

Translation into other languages

All information and documentation available in languages other than Spanish on this website is provided for information purposes only. In the event of any discrepancy between the content of the other language versions and that of the original Spanish version, the latter shall prevail.

Applicable law and jurisdiction

The relationship between Ercros, S.A. and the user shall be governed by the provisions of Spanish legislation.
Ercros, S.A. and the user, expressly waiving any other jurisdiction to which they may be entitled, submit to the jurisdiction of the courts and tribunals of the city of Barcelona (Spain).

User consent

The user declares to have read these general conditions, accepting and authorising, fully and expressly, all the provisions of each one of them every time he/she accesses www.ercros.es or uses its services.
It will be understood that the user accepts the established conditions if he/she presses the Accept button on the data collection forms.

Personal data will be stored in accordance with the rules set out in the privacy policy.

Privacy policy

The processing of personal data and the sending of communications by electronic means comply with the regulations established in Organic Law 15/1999, of 13 December, on the protection of personal data (BOE 14-12-1999) and in Organic Law 3/2018, of 5 December, on the protection of personal data and the guarantee of digital rights (BOE 6-12-2018).

Ercros, S.A. has installed the necessary security measures on the website to be able to guarantee the right to information and the security of its contents and the personal data stored in its information systems.

Ercros, S.A. reserves the right to vary this policy whenever it deems appropriate.

Personal data protection

Ercros, S.A. guarantees full compliance with personal data protection regulations, and thus, in accordance with the provisions of Organic Law 3/2018, of 5 December, on the protection of personal data and guarantee of digital rights (hereinafter LOPD) reports on its personal data protection policy so that users of www. ercros.es decide expressly, freely and voluntarily whether they wish to provide Ercros, S.A. with the personal data requested on the website, when making any enquiries by sending information request forms. Unless specifically established otherwise, it shall be considered necessary to complete all the data required in the forms indicated as obligatory fields. In the event that the user does not provide the compulsory data requested, Ercros shall not be able to process the form in question. The user must fill in the forms with true, exact, complete and up-to-date data, and shall be liable for any damages that may be caused by filling in the forms with false, incomplete or out-of-date data.

In this way, the user is informed and gives his or her consent to the incorporation of his or her data into the company's existing automated files and to the automated processing thereof for the purposes of the requests made by the browser through the information request form, which is the only point of entry for personal information.

Ercros, S.A. has adopted the personal data protection security levels required by current personal data protection legislation, installing and implementing the necessary technical and organisational measures to prevent the loss, misuse, alteration, unauthorised access and other possible risks. At the same time, it undertakes to comply with its obligation to maintain the secrecy of personal data and its duty to store them and will adopt all necessary measures to avoid their alteration, loss, unauthorised processing or access, taking into account the state of technology at all times.

In relation to the data sent by the user, the user may at any time exercise their rights of access, rectification, cancellation and, where appropriate, opposition in accordance with the provisions of the LOPD and other applicable regulations to that effect, by sending a letter, enclosing a copy of their ID card or passport, by the means provided for in Royal Decree 1720/2007, of 21 December, which approves the Regulations for the development of Organic Law 15/1999, of 13 December, on the protection of personal data, to the Ercros Institutional Relations and Communication Department by e-mail to ercros@ercros.es, by fax to (+34) 934 308 073 or in writing to Ercros, Avda. Diagonal 593-595, 10th floor, 08014 Barcelona, always stating the identity of the user.

Likewise, neither does it assume responsibility for the content of pages not managed by Ercros which are accessed through links included in www.ercros.es.

Ercros, S.A. reserves the unilateral right to prohibit, limit or demand the cancellation of links pointing to the domain www.ercros.es, when it deems appropriate, by simply notifying the owner of the website, without being obliged to pay any type of compensation for this reason.
